This document is an agreement between You and APRIL International Care France (“AICF”) governing the conditions of use of the AICF application, AICF EASY CLAIM (“Application”). This agreement and any updates to the content or software constitute the “Agreement” between You and AICF. By installing and using the Application, You are formalising your acceptance of these terms. If You do not accept these terms, You must not install or use the Application. AICF may deny You access to the Application in the event of non-compliance, either in whole or in part, with the provisions of this Agreement.

The Application is granted to You, not sold, under the terms of this Agreement. AICF reserves all rights not expressly granted to You.

1-Processing of your personal data

The Application and the electronic processing of personal data from this application site have been declared to CNIL, the French data protection agency.

AICF uses the information You send them to store your login preferences, and if You have so decided, to pass on your opinions and ratings in respect of healthcare professionals mentioned in the Application. Information regarding your opinions and ratings will be made public in the Application. Under (EU) Data Protection Regulation n°2016/679 of 27 April 2016, you have the right to access, rectify and erase data which is inaccurate, incomplete, ambiguous, out-of-date or whose processing would be unlawful, and object to and restrict the processing (in the cases provided for by law) and portability (in the cases provided for by law) of your data. You also have the right to specify instructions for the storage, erasure and transfer of this data after your death. Remember to send a double-sided photocopy of your ID with your request. In accordance with the provisions of Article L561-45 of the French Monetary and Financial Code, with regard to data monitoring for the purpose of combatting money laundering and the financing of terrorism and the application of financial sanctions, you can exercise your right of access by applying to the French Data Protection Authority, Commission Nationale Informatique et Libertés - 3 Place de Fontenoy - TSA 80715 - 75334 PARIS CEDEX 07. You can make a complaint to the French Data Protection Authority, Commission Nationale Informatique et Libertés, online or by post if you feel, having first contacted us, that your rights are not being respected. You can opt out of marketing communications from us by contacting our Data Protection Officer. For marketing emails you can also opt out by clicking on the unsubscribe link in the email you received. For telephone marketing you can opt out by contacting Opposetel (www.bloctel.gouv.fr/) in application of Article L121-34 of the French Consumer Code.

In addition, You agree that AICF may from time to time collect and use technical data and any other type of information about geotracking, collection of events, information regarding your device, access to camera, calendar and folders, about your device, software and operating system and its peripheral devices to facilitate software updates, support and other Application services. The app does use third party services that may collect information used to identify you. 2- Information and services

The information and services contained in the Application are provided as a general guide and should not be deemed to be advice. They do not claim to be exhaustive. In spite of updates to the Application content, AICF will not be held liable for changes in administrative and legal provisions occurring after publication. AICF reserves the right at any time and without notice to amend and update these services and information.

The information presented in the Application is in no way intended to provide medical advice or form a medical diagnosis. The Application will not interact with your medical records and will not pass on any information about your health.

The information presented in the Application is intended to show You, and You alone, the system for claiming the reimbursement of medical expenses. The Application does not constitute automatic acceptance of the claim. We need to collect sensitive personal data (medical and health information) in order to manage the claims for reimbursement which are submitted to us.

Claim for reimbursement form :

When You claim a reimbursement from AICF using the “New claim for reimbursement” form, You authorise us to store the information in order to process your claim. You must keep the original invoices for a minimum period of 2 years from the date on which You submitted the claim for reimbursement. You may be asked to produce them in order for your claim to be processed.

The information You provide may be used by us during the claims management process (including applications for insurance, claims processing, reinsurance and fraud prevention). AICF may be required to call on third parties to process the data on its behalf. Such operations, which may be carried out outside the European Economic Area (EEA), are subject to contractual restrictions on confidentiality and security.

We may pass on your details to our agents, members of the APRIL Group, other insurers and their agents, service providers and any intermediary representing you or the regulatory/governmental authorities (of which we are a part or by which we are governed). We may, in some cases, use the services of private investigators to obtain more information about one of your claims for reimbursement.

The use of third party Services may require Internet access with a request that You accept their own terms of use. You agree to use third party Services at your own risk and accept that AICF will not be held liable for any content about which You may make a complaint.

3- Copyright

Brands:

The APRIL brands and the APRIL product brands mentioned in the Application are registered trademarks and are the property of AICF.

Photo and illustration copyright:

All the rights of the owner of the photos and illustrations used in the Application are reserved. Any reproduction or use of the photos and illustrations in the application, other than for individual and private viewing are prohibited, unless authorised.

Content copyright:

All the rights of the owner of the Application content are reserved. Any reproduction and use of the Application content other than for individual and private viewing is prohibited, unless authorised. The Application content and graphics are the property of AICF or are used by AICF with the agreement of the copyright holders.

Any use which is not expressly authorised is a violation of copyright and constitutes an infringement. AICF reserves the right to take legal action which may incur the civil or criminal liability of the perpetrator.

4- Liability

AICF will not be liable for:

- damage of any kind resulting directly or indirectly from the content and/or access to and/or use of the Application including but not limited to any business interruption, loss of programmes, loss of data, any deterioration or viruses that may infect computer equipment or any other property belonging to the user of the Application,

- technical or other problems making access to the Application difficult, unpredictable or impossible, whatever their cause and origin.

User liability:

The User is liable for any direct or indirect damage caused to third parties, including AICF, as a result of the illicit use or exploitation of the Application itself or of one of its components and the consequences of any legal claims and actions that may be made or taken against him or her as a result.

5-Applicable law

This Agreement and any claims arising from it will be subject in all respects in accordance with French law and with the parties agreeing to submit to the exclusive jurisdiction of the Paris courts.
